Dear Potential IPA Member,

This is a follow-up communication to my letter sent to you earlier this week.

I am providing additional information to allay concerns about where you will be integrated into the IPA seniority list when we complete an agreement with the Company. I have included a letter from Daniel Katz, whose law firm, Katz and Ranzman. P.C., is the most knowledgeable and experienced in the country in these matters. Mr. Katz has been a part of nearly every major airline seniority integration and merger that has occurred during the past 25 years. He recently completed the integration of the Delta and Northwest pilot groups.

Regardless of what UPS is telling you in their meetings and behind closed doors, we will not accept any agreement that attempts to place you at the bottom of our seniority list. We have many years of past practice and arbitration rulings that support Date of Hire (DOH) as the primary consideration on where you will be integrated into our seniority list. DOH is how the IPA intends to incorporate you into the existing UPS Crewmembers Seniority List.

I have included a copy of the UPS/IPA Collective Bargaining Agreement (our contract). Please consider your date of hire and take a look at Article 12 – pay, and Article 13 – Scheduling, to see some of the benefits of being an IPA member.

Also consider that you currently have no working agreement with UPS and as such you could be let go at any time and have absolutely no recourse or right to return to work such as those rights afforded to a furloughed IPA crewmember. Once you sign the card you are protected under Federal Law from retaliation by UPS.

You can review the Rob Dorsey case (link below), mentioned in the letter from Mr. Katz. That court decision should allay any fear about retaliation by UPS in the event you sign the card. Mr. Dorsey received a confidential settlement that was reported to be in the seven figure range.

The IPA website contains additional information of interest and also provides an address to which the cards can be mailed if you did not receive a stamped, addressed envelope. I have also provided additional cards in the mailings in case you or a friend did not receive one previously.

In addition, if for any reason you are unable to fill out and return the Authorization Card that was mailed to you, the website provides a .pdf version of the Authorization Card that may be downloaded, printed, filled out and sent directly to me at the IPA. It should be printed on plain white card stock, and signed and dated in your own handwriting.
